For the SFA s.202 offence, what must be shown in addition to the dissemination of information about the price effect of an illegal transaction?
Section 202 requires that the disseminator or an associate has entered into or purports to enter into the illegal transaction, or has received or expects to receive consideration or a benefit for the dissemination. The guide calls this a blackout rule to stop those in the know from profiting from manipulation.
No need to prove the price moved; the offence is complete on dissemination with the required link.
